Our services include designing and building multi-channel outreach systems, automating email, SMS, and social media follow-up sequences, building targeted prospect lists and lead qualification workflows, and providing consulting and strategy related to outbound sales systems.
All services are delivered remotely. Scope, timelines, and deliverables for each engagement are agreed upon in writing before work begins.
Eligibility
Our services are intended for business owners, operators, and professionals. By booking a consultation or engaging our services, you confirm that you are at least 18 years of age and have the legal authority to enter into a service agreement on behalf of yourself or your organisation.
Booking and Consultations
Free consultations are available through our Calendly booking page accessible at shamikhjaved.com. By booking a consultation, you agree to provide accurate information, attend at the scheduled time or provide reasonable notice if you need to reschedule, and acknowledge that the consultation does not constitute a binding service agreement.
During the booking process you will be presented with an SMS consent checkbox. Checking this box indicates your explicit consent to receive SMS communications from us related to your inquiry and our services. This checkbox is never pre-checked and consent is entirely voluntary. You may opt out of SMS communications at any time by replying STOP to any message.
Service Agreements
Paid services are governed by a separate written service agreement signed by both parties. That agreement will specify the exact scope of work, deliverables, timelines, payment terms, and any other terms specific to your engagement. In the event of any conflict between these Terms and Conditions and a signed service agreement, the service agreement takes precedence.
Payment Terms
Our standard payment model is a monthly retainer as described on our website. Specific payment amounts, due dates, and accepted payment methods are outlined in your service agreement. All fees are non-refundable unless otherwise stated in writing. We reserve the right to pause or terminate services if payment is not received by the agreed due date.
Intellectual Property
All content on shamikhjaved.com including text, graphics, logos, and images is the property of Shamikh Javed and Simation Technologies and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this website without prior written permission.
Work product created specifically for a client as part of a paid engagement becomes the property of the client upon full payment unless otherwise agreed in writing.
Client Responsibilities
To enable effective delivery of our services, clients agree to provide accurate and complete information about their business, ideal customer profile, and goals, respond to requests for feedback and approvals in a timely manner, ensure that any contact lists or data provided to us were obtained lawfully and with appropriate consent, and comply with all applicable laws and regulations related to their own outreach and marketing activities.
We are not responsible for outcomes resulting from inaccurate information provided by the client or failure to meet these responsibilities.
Compliance and Lawful Use
You agree to use our services in compliance with all applicable laws including but not limited to the CAN-SPAM Act, the Telephone Consumer Protection Act, and any applicable state or federal regulations governing email, SMS, and digital marketing. You agree not to use our services to send unsolicited communications to individuals who have not consented, engage in deceptive or misleading outreach, violate the terms of service of any platform used as part of your outreach, or conduct any activity that is unlawful, harmful, or fraudulent.
We reserve the right to terminate services immediately and without refund if a client engages in unlawful or non-compliant activity.
SMS Communications
By opting in to receive SMS communications from us through our Calendly booking page, you consent to receive text messages related to your inquiry and any active or potential service engagement. Message frequency varies based on the nature of your engagement. Standard message and data rates may apply depending on your mobile carrier.
You can cancel the SMS service at any time by texting STOP to the number you received messages from. After you send STOP we will send one final SMS confirming you have been unsubscribed. After this you will no longer receive SMS messages from us. If you want to receive messages again just sign up as you did the first time. If you are experiencing issues with the messaging program reply HELP for assistance or contact us directly at hello@shamikhjaved.com.
Carriers are not liable for delayed or undelivered messages.
We do not send unsolicited bulk SMS. All SMS communications are sent only to individuals who have explicitly opted in. Consent is entirely voluntary and is never a condition of booking or purchasing our services.

Limitation of Liability

Results depend on factors outside our control including market conditions, the client’s offering, and prospect behaviour.

We are not responsible for changes to the terms, policies, or functionality of any third-party platform that may affect your campaigns or workflows. It is your responsibility to ensure your use of any platform complies with that platform’s terms of service.
Termination
Either party may terminate a service engagement with written notice as specified in the relevant service agreement. We reserve the right to terminate access to our website or services at any time if these terms are violated.
Upon termination, all outstanding fees become immediately due. Any work completed up to the termination date remains billable.
Governing Law
These Terms and Conditions are governed by the laws applicable to your jurisdiction as a client. For clients based in the United States, any disputes shall be resolved in accordance with applicable US federal and state law. We operate internationally and aim to comply with all relevant legal frameworks in the jurisdictions where our clients are located.
